The battle to preserve Verlorenvlei continues

Bongani Minerals started to drill illegally in Moutonshoek Valley in March this year, contravening the Land Use Planning Ordinance. They, together with the farm owners concerned, were then interdicted by the Bergrivier Municipality for illegal land use. After the Constitutional Court judgement in favour of the municipal land use ordinance was passed in the landmark Maccsand and Swartland municipality cases, Bongani had to concede and the interdict was enforced without opposition.
Bongani has now applied for a departure from the legal land use, which in this case is Agriculture 1, in order to proceed with their drilling operations.
